The ‘FreshWater Five’ have lost their appeal after being convicted in 2010 of attempting to smuggle 250kg of Cocaine into the UK.

Jonathon Beere, 51, and Daniel Payne, 46, two members of the ‘FreshWater Five’, have lost a bid to overturn their convictions in the court of appeals on Wednesday.

The pair were jailed in 2011 along with three others after allegedly trying to smuggle drugs through Freshwater Bay, just off the coast of the Isle of Wight.

In a statement, their families expressed their disappointment with the verdict, saying that ‘this is a bitter and dark day for the men and their families.’

Emily Bolton, who represents the charity Appeal, described the ruling as a ‘miscarriage of justice.’
