On 15 November the Supreme Court met to hear the appeal of the man, an illegal immigrant who was arrested for terror offences more than five years ago.
His nationality has never been confirmed. In February 2014, it was found that there was no prospect of him being deported, so charges against the man were dropped.
He was then released, but in April 2014 he was given conditional bail.
The man has been living with these bail conditions ever since.
In court on Wednesday his lawyers argued that since he was not being charged with anything, the court has no right to impose bail or bail conditions.
The defendant may have to wait up to 6 months for the Supreme Court to reach a final judgement.
